    "TERMS & CONDITIONS
    1.Should the stallion die or become unfit for breeding before servicing the mare, this contract shall become null and void. Diamond Creek has the sole discretion in determining the fitness of the stallion and may refuse to breed any mare by transported semen. Diamond Creek is not responsible for any changes in stake conditions to be made by the sponsors of such stakes at any time.
    2. Agent/Owner has no reason to believe the mare is unable to achieve and sustain a pregnancy that results in a live foal. Should the mare become unfit for breeding, the Agent/Owner must supply a veterinary statement giving the reason for the change in condition within 3 business days of the change. The Agent/Owner may not be able to replace the mare with another candidate if the mare has been serviced by the stallion due to the USTA rule 26.06 limiting stallion books to 140 mares. In the event of death of the mare or extraordinary circumstances approved by the Registration Committee of the USTA,Diamond Creek has the discretion to allow the mare to be replaced.
    3. The mare shall be made available for breeding to the stallion through June 20, 2026, or until pronounced “in foal” by a veterinarian. If the mare is barren and breeding ceases before the afore mentioned date or is serviced to a stallion other than the one listed in this contract, a following fee will be charged: $2,000 for contracts equal to $10,000 or less or half the stud fee for contracts greater than $10,000.
    4.Breeding Right and Share Owners release Diamond Creek from any liability pertaining to payment of the stud fee for mares booked on their breeding and understand that once a mare is booked, it will count as “nomination used” and are not entitled to any income related to the share or breeding right, whether the mare produces a live foal or not.
    5.The stud fee is due and payable to Diamond Creek within 30 days of the mare producing a live foal,as defined as a foal that stands and nurses independently. Agent/Owner is responsible for paying any applicable taxes and fees. Any stud fees paid after July 31st, 2027, will be considered late – any discounts will be voided and the fee due will revert to the full 2026 advertised stud fee & a 10% interest will be applied as well as $200 per month starting September 1st, 2027, until paid. Mating certificate will not be released if all fees are not paid including but not limited to late fees, stud fees, collection fees, semen shipments, boarding expenses, etc.
    6.The stud fee is due immediately if the mare or recipient of the mare is leased, offered for sale, or if the ownership of the mare’s changes. Stud fees are non-refundable – once paid the agent/owner forfeits any right to request a refund of the stud fee, or a return booking in subsequent seasons.
    7.Agent/Owner understands the 2026 credit card authorization, mare information, shed polices, and terms & conditions forms attached hereto, are REQUIRED to be completed, signed, and returned; if there are additional owners, a completed additional owners form must be returned with this contract, or the signatory shall be billed 100% of applicable collection fees and stud fees. If billing changes after the mare is serviced, there will be a $50 admin fee applied to each owner.
    8.The afore mentioned forms have been received, reviewed,and forwarded to the person(s) responsible for placing semen orders. The Agent/Owner agrees to adhere to all policies and procedures listed therein. Diamond Creek reserves the right to refuse a cover if any required paperwork is missing.
    9.Agent/Owner agrees that they are an active member in good standing with the USTA and must maintain that membership throughout the entirety of this contract. A Person Not in Good Standing is defined by the USTA rule4.129. Per USTA rule 20.17, Agent/Owner must notify the USTA as well as Diamond Creek if they become a member not in good standing.Diamond Creek will not service the mare if membership status changes. "
